Kakamega police station OCPD David Kabena has confirmed that two men were arrested on Friday in Kakamega County for getting intimate with each other.
The happenings at Shikhambi estate was alerted by area residents who called the police after suspecting the two guys of ‘enjoying the fruits of freedom’ on each other.
“We have been watching their movements and suspecting them of this kind of behavior. We decided to lay a trap on one of them and found him with another man. This kind of behavior should be condemned in our society,” said Nyumba kumi elder Reuben Otiende who added that they are suspecting such men of defiling under age boys within the area.
According to Mr. Otiende , their trap yielded fruits when they stormed into the suspect’s house and found him in the company of another man and were engaging intimately.
Area residents said they demanded to see the suspect’s phones and found messages that suggested that the two were having an affair.
Kakamega police swung into action and saved their lives as the area residents were ready for mob justice.
In May 2019, Kenya’s high court upheld a law banning gay sex, keeping same sex relations punishable by 14 years in jail.
The court was addressing a petition filed in 2016 by three Kenyan organizations that work to protect the rights of lesbian, gay, bisexual, and transgender people.
It rejected the petitioners’ case that the laws violate constitutional protections, stating that the provisions are not discriminatory because they do not single out LGBT people, and that the petitioners had not proved their rights had been violated under the laws.
The same Court later argued that the constitutional rights to privacy and dignity are not absolute and should be read in the context of article 45 of the constitution, which states that “Every adult has the right to marry a person of the opposite sex.”
Now OCPD Kabena says the two will soon be arraigned in court as the Kenyan public is eager to see if they will serve 14 years in jail or the gay/lesbian activists will come to their defense.
